Welcome to DigitalMedia88.com. By accessing or using our website and services, you agree to the following Terms and Conditions, which govern your use of our services as a client of DigitalMedia88, a professional digital marketing and IT consulting firm based in India.
1. The Contract
- Independent Contractor Relationship:
DigitalMedia88 operates as an independent contractor. Nothing in this agreement creates a partnership, joint venture, or employment relationship between DigitalMedia88 and the client. - Service Commencement:
The start date of services will be mutually agreed upon. Charges will apply from the agreed commencement date. - Monthly Reports:
Clients will receive monthly performance reports for ongoing services. - Cancellation and Transfer:
Either party may terminate or transfer service responsibilities by providing a minimum of ten (10) business days’ written notice. DigitalMedia88 reserves the right to subcontract third-party providers as needed. - Third-Party Rights:
No person or entity other than the parties involved shall have any rights under this agreement.
2. Payments
Monthly Services:
For monthly service packages, clients must pay the full invoice amount in advance before work begins.Fixed-Quote Projects:
For fixed-price projects, 70% of the total cost must be paid in advance, with the remaining 30% due within ten (10) days from the service start date.Invoicing and Non-Payment:
Invoices are issued monthly in advance. If payment is not received by the due date, DigitalMedia88 reserves the right to suspend or terminate services immediately without prior notice.
3. Liability
Service Delays:
DigitalMedia88 is not liable for delays or service interruptions caused by natural disasters, technical failures, or other uncontrollable events.Client Indemnification:
Clients agree to indemnify and hold harmless DigitalMedia88 from any claims, liabilities, or damages arising from:Misuse of our services
Intellectual property violations
False advertising by the client
Product or service liability
Content provided by the client for publication
Content Publication:
Clients are responsible for the accuracy and appropriateness of any content provided for publication. Once published, content may be accessible to the public. DigitalMedia88 does not accept responsibility for any resulting reputational or financial loss.
4. Governing Law
These terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra, India.
